DVC requires a written rental agreement for all rentals: a written contract or a letter of contract signed by both of you, which specifies exactly what the rent will cost, when payment is due, the date of the stay, etc., will go a long way in establishing clear expectations and responsibilities of both parties. An earlier version was published in various places some time ago, and variants of this agreement have been circulating for years. This one includes some minor updates to update it. 12. In the event of force majeure (as defined in this paragraph), each party will be released from any future performance of its obligations under this Agreement; provided, however, that if the Agent has collected 100% of the funds for the booking from the Renter, the Agent will provide the Renter with a credit limited in value to the amount paid for the Booking, the __ US dollar will be on the terms and conditions determined by the Agent in its sole discretion, as soon as reasonably possible, after the condition(s), which constitute the event of force majeure, has been/will be communicated through the intermediary to the tenant and the owner. Force majeure is an event beyond the reasonable control of the Agent that renders impossible or materially interferes with the execution of a Rental Reservation with respect to the Owner`s Rented Points, including, but not limited to, cases of force majeure, acts of government, embargoes, war, riots, epidemics, pandemics, natural disasters, government restrictions, and Disney Vacation Club reservation closures or cancellations. 1. Terms: All sales under this Agreement are final.2. The intermediaries advised the tenant to consider taking out trip cancellation insurance.
If the tenant has indicated that they are not a resident of the United States, the agent also recommends that the tenant consider purchasing travel health insurance.3. Agent will not be responsible for any changes to operation or equipment (collectively, the « Modifications ») made by Disney Vacation Club in connection with the property where Renter is booking their trip. This includes, but is not limited to, the operation of resort restaurants, swimming pools, playgrounds and other amenities controlled by the resort. The Walt Disney Company and disney Vacation Club are constantly improving their resorts and properties for the current and future enjoyment of all guests. The tenant`s travel or resort amenities may or may not be affected by construction at Disney Resort resorts and hotels. Although Disney offers the tenant access to alternative amenities, intermediaries and landlords assume no responsibility for any changes or situations beyond their control.4. Neither the agent nor the landlord accepts responsibility for certain room requests that are not considered or accepted by Disney at the time of the tenant`s arrival.5. Note: All Disney Vacation Club homes, including balconies, are NON-SMOKING. The tenant receives a cleaning fee from the Disney Vacation Club if a NON-SMOKING AREA is smoked. The tenant must confirm this upon check-in.6. The Agent has received from the Renter a NON-REFUNDABLE payment of ___ US dollars in exchange for a confirmed booking using the Owner`s Disney Vacation Club Points at Disneys __ The DVC Owner further agrees with the Agent, agent and Renter with an active booking all costs related to a cancellation of the booking incurred by or in connection with the default of the DVC Owner, to comply with the booking or otherwise fail to comply with all the terms and obligations of this Agreement have been fully reimbursed, including, without limitation, all attorneys` fees, attorneys` fees, legal fees and costs and expenses related to the collection of such costs.
This Agreement shall be governed in all respects by the laws of the State of Connecticut, United States of America. All parties agree that all disputes under this Agreement will be heard in the courts of Fairfield County, Connecticut. If any part of this Agreement is held to be illegal, void, or unenforceable by the courts of Fairfield County, Connecticut, this shall not affect the validity and enforceability of the remaining terms. 13. This is an agreement to rent points which constitute only accommodation. There are no plans for tickets, transportation, meals, transfers, insurance, or other items. These optional extras purchased as part of this booking (e.g. B meal plans and parking tickets) are subject to Disney Vacation Club terms and conditions, must be paid for separately by the tenant, and are not covered by this rental agreement. 14. The tenant understands that there is no daily maid service at Disney Vacation Club Resorts, but a garbage and towel service.
If the tenant`s stay is less than eight nights, the tenant will receive a garbage and towel service on the fourth day. If the tenant`s stay lasts eight nights or more, the tenant will receive a full cleaning service on the fourth day and a garbage and towel service on the eighth day. After that, the cycle starts again on the twelfth day. The first day is the day of check-in.15. If accommodation is not available on the day of arrival due to an act or omission of the owner, including, but not limited to, negligence on the part of the owner, and, after communication with the agent, appropriate comparable accommodations as determined by the agent at the sole discretion of the agent are not secured for the same data by the owner, the parties agree that the tenant will be entitled to a refund, which is limited to the amount paid, which amounts to ____ US dollars, the refund of which is the responsibility of the owner. Documentation Requirements: If the tenant is not a U.S.
citizen residing in the United States of America, the tenant must present a valid passport in order to enter and exit the United States of America. Citizens outside the United States of America without a valid passport will be denied entry to the United States of America. Entry into the United States of America may be refused even if the required travel information and documents are complete.18. The standard of living and practices at destination, as well as the standards and conditions set out therein with regard to the provision of public services, services and accommodation, may differ from those of the tenant`s country of residence. DVC Points Rental Agreement: As mentioned under « An Explanation of Rental Points », it is important that the DVC Member and the Tenant/Guest have clear expectations with respect to a particular rental. Provide the Agent with full details of the number of Points available for rental during the specified rental year The DVC Owner further agrees to fully indemnify the Agent against and with respect to all losses, costs, damages and claims incurred or incurred by the Agent as a result of the DVC Owner`s failure to comply with any liability or obligation under this Agreement. Number of points available for rental during the specified rental year: The owner of DVC accepts and promises not to put it up for sale and not to put it up for sale and not to put it up for sale with another owner for rental, using the active booking points for tenants through it. DVC members who have praised in the past are welcome to comment on this and suggest changes. This could be used by members who have not entered into a written agreement in the past.
